Equality Act 2010
Received: 19 August 2025
HelloPlease could you confirm that you are aware of and complying with the The Supreme Court judgement in the case of For Women Scotland (FWS) v The Scottish Ministers, which ruled that the term "sex" in the Equality Act 2010 refers to biological sex, not gender identity. This means that a Gender Recognition Certificate (GRC) does not change a person's sex for the purposes of the Act. The court's decision clarifies that the Equality Act 2010 uses "man" and "woman" to mean biological sex at birth. Please supply any messages you have sent to your staff and departments, via email, staff newsletters, intranet messages or via any other communication method in order to ensure they are clear as to what is required. Please could you also let me know what training has been provided to ensure all staff are aware of & understand their responsibilities to comply with the law regarding service provision etc ?
