The representors concerns are regarding the compliance of Policy CDH04 with London Plan Policy D9 and the compatibility of Policy CDH04 with the Edgware development (it is not clear whether this is in relation to Site 27 or Site 28).
Any future planning for the redevelopment of Site 27 and Site 28 would be assessed against the development plan, including London Plan Policy D9.
Reference to ‘Very Tall’ buildings in Policy CDH04 has been deleted in the Main Modifications.
Any impact height has on character and appearance would be assessed as part of a planning application.
Discussion regarding a maximum height and the mapping of location where tall building may be appropriate is detailed in the Council’s response to the Greater London Authority.

- London Plan Policy D9C to which CDH04 cross-refers sets out an extensive list of criteria that tall building proposals are expected to address. In order to meet a change to the Building Regulations in March 2024 CDH04E will be subject to modification replacing height threshold of 30 metres with 18 metres. Local Plan Policy CHW03 emphasises the importance of addressing crime and fire safety issues early in the design process.
- The Council needs to make sure that all decisions on parking, the scale of parking given up and likely demand on/for active and sustainable provision are evidence-based. In considering local capacity the Council will seek a Parking Design and Management Plan and may use planning obligations / legal agreements to control the layout and management of the parking spaces, including the nature of the users and the pricing structure. The Parking Design and Management Plan should demonstrate the suitability and arrangements for any retained or proposed parking as well as showing what steps will be taken to ensure minimum disruption to parking in the town centre or local area during construction.
- Barnet’s Local Plan can only show what happens in Barnet. This was highlighted by the Inspector. Therefore, we cannot show boundaries that extend out of Barnet. However, the supporting text reflects that the Growth Area extends into Harrow and policy GSS05 emphasises joint working with Harrow as well as highlighting the Growth Area SPD. The SPD as a joint planning document with Harrow is able to show the full Growth Area.
- The Council does not oppose the modification to GSS05 proposed by LB Harrow with regard to the status of the SPD. See response to LB Harrow
- In terms of heritage Policy CDH08 is in accordance with the NPPF and the Planning (Listed Buildings and Conservation Areas) Act 1990. The Council is required to have regard to impact on heritage assets irrespective of whether they are in the Borough or not.
- See response to Save our Edgware and Edgware Community Association with regards to Site 27 and Site 28 and proposed modifications referencing the nearby conservation areas in LB Harrow.
- Policy ECC04 sets out expectations of new open space provision as well as improvements to existing open spaces from development proposals.
- MM46 in relation to Policy CDH04 outlines the reasons why the modifications are necessary to make the policy sound. This includes alignment with London Plan policy D9(C). The Council now makes a specific reference to London Plan Policy D9C so that there is no inconsistency in terms of what tall building proposals are expected to address.

Council’s Response to Inspectors
1. The Council does not consider there to be a conflict between the objectives in MM07 Table 2. If there was a conflict the Inspector would’ve raised this in his letter of August 17th. This table highlights the most relevant policies. Policy GSS01 Delivering Sustainable Growth sets the scene for the Local Plan’s approach to Growth and Spatial Strategy, therefore it appears as the most relevant policy against the majority of the key objectives.
2. The Local Plan is supported by an extensive history of evidence base documents which includes an assessment of housing needs in the Borough. The Housing Strategy 2023-28 sets Barnet’s strategic direction for housing activity in the Borough and highlights that there is not currently enough suitable housing for everyone to have a safe, secure, and affordable home. The Housing Strategy in partnership with the Local Plan will ensure an up-to-date understanding of the tenures being delivered across all development within the Borough, helping to influence the supply from registered providers and private developers against the levels of housing need.
3. The Local Plan sets out the strong partnership that it has with the Housing Strategy. It highlights that in order to reflect on change within housing needs in Barnet the size priorities for affordable properties will be informed by an annual assessment of the Housing Needs Register.
4. The changes to Policy HOU03 help clarify the Plan’s approach to ensuring that the provision of family accommodation is not lost when larger homes are subject to conversion or re-development. It does not entail that developers in response to this policy will decide to convert larger homes into HMOs. Applications for HMOs will be determined in accordance with HOU04. Unacceptable impact is considered to be the appropriate term and it is used consistently throughout the Local Plan.
5. The Local Plan refers at para 5.12.5 to the importance of HMOs as a source of low-cost housing. Therefore the Council considers that the existing wording is appropriate and no change is merited.
6. The Council does not consider a change is merited to MM16. Discussions concerning alternative locations sit outside the plan making process. In accordance with the adopted North London Waste Plan sufficient land areas have been identified by the seven North London boroughs to manage the waste target set by the London Plan. With specific regards to the Brent Cross waste sites, it is acknowledged within the Local Plan that these sites will be redeveloped and that replacement capacity will be found within the Borough. The Council will consider the relocation and whether it is permanent, as part of the planning application process (which is appropriate mechanism) if a proposal is confirmed and comes forward for an alternative use prior to review of the London Plan and or North London Waste Plan.
7. The Council has been required to make the changes to Policy CDH04 for the reasons set out in MM46 of the Table of Modifications. We refer to our earlier response with regards to the objectives in Table 2. The existing Local Plan – Core Strategy (adopted 2012) (Core_Gen_14). Policy CS5 identifies Edgware as a specific location for tall buildings. Edgware has therefore been, since 2012, a location where tall buildings may be appropriate. Edgware is also designated as a Growth Area, which has been further supplemented through the joint SPD produced by Barnet and Harrow. The Growth Area is further ratified in the Local Plan. The Designing for Density SPD together with the Sustainable Design and Development Guidance SPDs are expected to be published for public consultation in late 2024. These SPDs are committed to provide detailed guidance to support the implementation of the Plan. In order to make the policy and supporting text effective and sound the Council were required by the Inspectors to make modifications throughout the Local Plan. The removal of the text ‘so not to detract from the nature of surrounding places and the quality of life for those living and working around them’ in para 6.18.3 reflects such change.
8. CDH04 sets out that planning proposals will have to consider the Locally Important Views. The last sentence of para 6.18.12 clearly states that the Council will resist proposals that cause harm to these views.
9. The Council refers to TOW04 which is the policy on the Night Time Economy. TOW04C makes specific reference to impact on living environment of anti-social behaviour and also highlights the policy on Making Barnet a Safer Place (CHW03).
10. CHW01Ab is highlighting the need for community infrastructure to be inclusive so that there is no design barrier to efficient use. This helps community infrastructure including Places of Worship to adapt to changing needs.
11. The Council considers this a response on MM68 rather than MM67. Policy ECC04 is supportive of proposals that help optimise the benefits of open space in Barnet. Proposals for facilities within parks will be considered with regard to ECC04.
12. The Council is committed to an early review of the Plan and has identified within Table 3 those strategic policies, including TRC01 – Sustainable and Active Travel, that will be the focus of the review. This will enable the Plan to better reflect the changing demography of the Borough as identified by the results of the 2021 Census.
13. The Council consider this is a response to MM76 rather than MM74. Item 7 of the Local Plan Monitoring Indicators – Table 24 highlights a number of Triggers and Contingencies for monitoring HMOs. If the number of unlicensed HMOs increases then there will be a need to review HOU04. Item 5 of Table 24 sets out a potential issue where appeals are allowed against the requirements of HOU03.

- MM24 – Site 44 - Development Timeframe relates to the life of the Plan from 2021 to 2036. Therefore the correct timeframe remains as 6 to 10 years as development is not expected to be delivered before 2026. The Council also considers that further changes to the wording on tall buildings is not merited. The modifications to policy CDH04 “Tall Buildings” reflects the modifications requested for soundness and for general conformity with the London Plan set out in the Inspectors letter of August 17th 2023. The reference to the pedestrian bridge says it should happen “if possible” and the question of whether it is possible or viable (not the same thing) is a detailed one that should be resolved through the development management process. This also applies to the precise routing of an alternative footway. The Council considers it entirely proper for the Local Plan to signal the Council’s expectations. It expects proposals to respond to the site requirements it sets out in the Local Plan and therefore does not consider that further change is merited. TfL can suggest and justify an alternative through the normal planning application process. This should be dealt with by the accompanying Transport Assessment. EXAM 36 sets out the assumptions behind the indicative capacity numbers in the Reg 19 Local Plan. EXAM 36 demonstrates how these assumptions have been applied on a consistent basis. Assumptions have not changed for Site 44.

- The Council welcomes this support for the changes to the site allocations.
- A site allocation does not inherently grant planning permission. Each application needs to be reviewed on its own merit. It only shows where development has been agreed upon in principle. When the site was granted planning permission for a mixed-use retail office and residential development under APP/N5090/W/22/3309568 in March 2023. Although the Local Plan was within the EIP the appeal Inspector did not give it significant weight. The appeal was allowed and the developer now has the opportunity to implement the consent. If the developer wanted to submit a new application it would be considered against the Local Plan requirements for Site 25 together with the new policy framework. A new application, with main town centre uses as a component of it, would still be required to provide an up-to-date sequential assessment.

Changes to the Policies Map - MOL

This representation originally dates from 2010 and previous consultation on the Local Plan Core Strategy (Core_Gen_14). It should be noted that the Council did not pursue a Site Allocations DPD and that no consultation on such a document took place.
The Changes to the Policies Map shows proposed changes to Green Belt and MOL boundaries resulting from a detailed Green Belt and MOL assessment (Barnet Green Belt and Metropolitan Open Land Study) (EB_GI_16). The assessment was based on a comprehensive and clear understanding of the planning policy and environmental context. All of the small number of proposed changes to Green Belt and MOL boundaries arise from inconsistencies and errors that have been identified.
This MOL site (Cheery Tree Woods – MOL16) was assessed as part of the Study. The Study commented on the respondent’s property stating that the ‘building abuts the urban edge at the eastern corner of the MOL however, as a larger building this is considered to impact the spatial openness of the land on which it sits. As it screened by vegetation however, it does not impact the openness of the wider MOL.’
The Study found that as potential for minor boundary adjustments the ‘Eastern edge (of the MOL) could exclude the dwelling and follow the edge of the park.’
The Council assessed all potential adjustments identified by the Study. It did not agree with the findings for Cherry Tree Woods and stated
The parcel recommended for removal is classed having strong openness, whereas the house within that parcel is shown as having ‘weak openness’ – as do all buildings within MOL. The parcel appears to be an ownership excised from the wider MOL parcel, and to create an irregular MOL boundary by excising this parcel from the MOL weakens the overall boundary. The dwelling and its curtilage must be seen as an incursion into the MOL, and their removal from the MOL would create a less defensible boundary. Boundaries should not be adjusted to accommodate development that has violated MOL or Green Belt boundaries, as has occurred in this case, as presumably the dwelling was built as a keeper’s cottage.

MM91 - Site 9- The residential proposal for Colindeep Lane has been withdrawn for the reasons set out at MM91. The proposal has been removed because ‘the site has been found to be not developable due to constraints arising from the extent and magnitude of flood risk affecting the site’. This is in line with Exam note 75 LBB Note on Site Allocations (updated 170323) paras 110-111. The Council’s intentions with regard to residential development of this site have changed and this is reflected in MM22 for GSS06.
MM23- Map 3D – The map has been revised to reflect the removal of Site 9.
MM22 – GSS06 - The Council has not been duplicitous or disingenuous with regards to GSS06. The revision at GSS06Bi reflects the need to minimise impacts from access improvements between Colindale Park and Rushgrove Park and to provide net gains for biodiversity in accordance with ECC06.
