As stated in GSS05B proposals will be expected to deliver or contribute to infrastructure. Specific forms of infrastructure are highlighted. This is in addition to requirements through policy such as community infrastructure, public realm, improvements to parks and open spaces.

The leisure options set out in GSS05 remain unchanged from the previous version of the Local Plan. New recreational activities and sports that would benefit local residents and the town centre are fully supported by the Edgware Growth Area SPD was adopted in June 2021.

The Growth Area SPD was produced jointly with LB Harrow and involved extensive engagement with communities and businesses as well as elected members of both councils. This SPD provides a planning framework with more detailed guidance for the Growth Area and the development sites within it.

MM3 - Progress is being made with LB Enfield and LB Haringey with regards to a joint planning framework for New Southgate. This work will inform the future opportunities, define the strategic boundary for the Opportunity Area with adjoining broughs and to an extent will inform early review considerations. is required for the Local Plan. It is also worth noting that LB Enfield and LB Barnet are at different stages in their respective Local Plan progress.

MM10 – The Council has made revisions to the Key Diagram in line with the Inspectors letter of August 17th 2023. Additional text to clarify that the symbol represents the “approximate” location of the Opportunity Area is not required for soundness.

The Council welcomes support for MM33, MM39

MM46-CDH04 – The Council is disappointed that the GLA have now raised this objection, having omitted to highlight it at the Reg 19 stage. The Reg 19 version did not set a maximum height for all tall buildings in Barnet. It did contain a definition for ‘very tall’ buildings’ which was noted as 15 storeys and above. ‘Very tall buildings’ (15 storeys and above) were to be differentiated between ‘tall buildings’ which previously had a maximum limit of between (8 storeys and 14 storeys/26 to 46 metres above ground level). It is this definition for very tall buildings’ and the differentiation between ‘tall’ and very tall’ buildings that has been deleted as a main modification and not a maximum height for all tall buildings in Barnet.

Therefore 14 storeys has never been proposed as a maximum height for all tall buildings in Barnet. As noted above there was an upper limit for ‘tall buildings’ previously in the Regulation 19, but there was not an upper limit for ‘very tall buildings’ or the ‘tallest buildings’ in Barnet. As such a request to introduce a maximum height for the tallest buildings in Barnet has come at late stage.

The Inspector’s request for the removal of this definition for ‘very tall’ buildings within CDH04 is set out at para 58 of the Appendix to Inspectors’ letter of 17 August 2023 (EXAM143A).

The Council also refers to para 59 of the Inspectors letter that requests consequential changes in the supporting text. This requests that cross reference is made to guidance on potential heights and locations of tall buildings as set out in the Tall Buildings Study Update (EB_DH_04).. This cross-reference is set out in the first sentence of para 6.18.5.

The Council maintain that they remain in general conformity with the London Plan in determining the locations where tall buildings may be appropriate, (in line with Policy D9 B 1) in these locations buildings of heights 8 storeys and above are deemed potentially appropriate. These locations have also been mapped in Map 4, this is line with the principle meaning of D9 B 2.

The Council does not oppose the proposed modification to CDH04E to make it align with the update to Approved Document B in March 2024:

“All new proposals must meet the requirements of the Building Safety Act 2022 with clear lines of responsibility for safety during design, construction, completion and occupation of high-rise buildings. Proposals that involve residential buildings over [30] 18 metres in height will need to provide two staircases to meet Building Regulations standards on Fire Safety”

The Council does not agree with the objection to para 6.18.3. The Council agreed this wording with the Inspector in response to the August 17th letter, (EXAM143A) para 59 of which requested the Council to explain that proposals for tall buildings outside the locations identified in CDH04A will be considered against development management considerations contained in CDH04.

With regards to MM47 - Map 4 the Council have produced it in line with the August 17th letter, para 60. The Inspector stated that Map 4 should be updated to include all the locations identified in the Tall Buildings Study Update (EB_DH_04). The main reason for revising Map 4 was to ensure that potentially appropriate locations for tall buildings are identified and reflect the evidence base. The Council will show the Locally Important Views on the Policies Map as well as on Map 4.

  1. MM75 - The Authorities Monitoring Report (AMR) is a document designed to assess the effectiveness of active policies within a local plan. Until this Local Plan is adopted, the AMR can only assess what is in the adopted Local Plan from 2012. (Core_Gen_14). (Core_Gen_15).   The most recent AMR was published in 2021 and was submitted with the Local Plan for Examination in November 2021. NPPF para 75 states that local planning authorities should monitor their deliverable land supply against their housing requirement, as set out in adopted strategic policies. The Housing Trajectory is therefore considered to be the most important element of the AMR. As part of the Examination the Council has kept the Housing Trajectory up to date and has published it in April 2024 as part of a Housing Supply Position Note. The Council therefore does not consider that there is a legal compliance issue.
  2. MM76 - The Council is committed to using the most up-to-date and accurate information available on flood events. The Environment Agency provides this resource on a consistent basis across the country Community based evidence can be submitted with regards to assessing flood risk on individual planning applications.

This representation’s assertion that the modifications would provide for ‘blanket bans’ misinterprets the Local Plan’s approach to delivering new homes that meet need and proactively securing family homes that are in high demand. One-bedroom homes remain part of the Borough’s housing supply, but there is less of a challenge to delivering this size of supply.

The approach in Policy HOU03, particularly criterion B and C (as modified), is necessary to prioritise the delivery of family homes from the conversion of existing housing stock, to address the needs for housing size by tenure as set out in Table 7 (as modified). Table 7 demonstrates that there is a significant need for family sized housing in the Borough as part of any market housing mix. One-bedroom homes remain the lowest priority for market housing, delivery of this size of accommodation frequently comes through new build supply but it is recognised that they still have a role to play in providing choice and supply.

Policy HOU03 criterion D has been modified to clarify the circumstances where proposals will be supported relative to the surrounding character of the area and where there is no unacceptable impact on the amenity of occupiers of neighbouring properties of the area.

There is no evidence to support an upturn in conversion of larger homes into HMOs as a consequence of HOU03. Table 24 sets out the Local Plan monitoring triggers and contingencies. Policy HOU04 part C has been modified to clarify the circumstances where proposals for HMOs will be supported.

The Council welcomes this support for delivering genuinely affordable housing.

The Council welcomes the broad support for MMs with regard to the historic environment.

MM44 - CDH02 - The Council do not oppose the proposed change to the 1st sentence of Para 6.13.4 by deleting the word ‘designated’ so it now reads:

"Sustainable design and construction measures must be considered having regard to potential impacts on the significance of a [designated] heritage asset (see Policy CDH08)."

MM46 - CDH04 - The Council welcomes support for the removal of reference to ‘very tall buildings’ and the mapping of sites that may be appropriate for tall buildings. The Council do not consider it necessary to reinstate the former CDH04 part E criterion iii as it has been replaced with a reference to London Plan Policy D9(C), which states that proposals should take account of, and avoid harm to, the significance of London’s heritage assets and their settings (in criterion d). For the same reason, the Council do not consider it necessary to refer to ‘the historic environment’ in Policy CDH04 part B (as modified) as it states that proposals for Tall Buildings must adequately address all [the Council’s emphasis] the criteria in London Plan Policy D9C.

The Council do not consider it necessary to modify Policy CDH04 part B to include a requirement that tall building proposals are accompanied by evidence showing that alternatives had been tested, as London Plan Policy D9(C) criterion d requires this where proposals result in harm, and as abovementioned, Policy CDH04 Part B has been modified to state that proposals for Tall Buildings must adequately address all the criteria in London Plan Policy D9(C).

The Council has identified locations which may be appropriate for tall buildings in Policy CDH04. Furthermore, Para 6.18.3 (as modified) states that applications for tall buildings proposed on sites outside of these locations need to be determined against relevant development management policy criteria. The Council considers the position is clear and it is not necessary to modify this text.

Considering Historic England’s comments on the reference to ‘minimise’, the Council do not oppose the following deletion to the 5th sentence of Para 6.18.3 as follows :

"Due to their potential impact, development proposals that include tall buildings must address all relevant parts of Policy CDH04 as well as the requirements listed in the London Plan (Tall Buildings Policy D9) which outlines the issues that proposals for tall buildings should address [to minimise the visual, functional and environmental impacts of such structures]."

Historic England’s guidance on tall buildings is already referenced in Para 6.18.3 (as modified).

MM49- CDH06 - The Council do not oppose the recommendation to make archaeological remains a relevant consideration for basement and below ground development. Therefore, the last line of Policy CDH06 should now read:

"Basement and below ground development will be considered with regard to the relevant requirements of Local Plan policies CDH01, CDH07, CDH08, ECC01 and ECC02."

The role of GLAAS is set out at CDH08, to which a new cross-reference has been added within CDH06.

MM51 - CDH08 – The Council highlights that this policy has been subject to a comprehensive redraft, under the guidance of the Inspectors, to align with the NPPF. Further revision with regards to the NPPF is not merited for soundness.

Heritage Impact Assessments - The Council do not consider it necessary to require proposals affecting heritage assets to be accompanied by a heritage impact assessment, as this goes beyond the requirements of Para 200 of the NPPF. Furthermore, the cumulative impacts of incremental change from development is addressed in London Plan Policy HC1(C) and the PPG (Paragraph: 013 Reference ID: 18a-013-20190723).

CDH08(A-B) - In terms of reference to Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, the Council consider it useful to remind the reader of the policy the duty under Section 72(1). Furthermore, the Council consider that harm to character and appearance both fall under the umbrella of significance. Nonetheless, the Council suggest changing the word ‘or’ to ‘and’ in CDH08 part A criterion c to read:

"the above criteria a) and b), will also be applied where development either inside or outside a conservation area (within its setting) has a harmful impact on its character, appearance [or] and significance, including where there would be adverse effects to buildings, trees, landscaping or open space, including gardens, that contributes positively to its significance."

CDH08 part A criterion e does not require changing as it uses the word ‘and’.

‘Building hierarchy’ is not a requirement of the NPPF or London Plan and therefore the Council do not consider it necessary to modify the policy to refer to it.

CHDH08(E) - To clarify the position of what is considered a non-designated heritage asset the following changes are proposed: The first para of CDH08 is amended to read:

"In accordance with national policy, the Council will ensure that Barnet’s designated heritage assets (designated and non-designated), including its conservation areas, statutory listed buildings, scheduled monuments, registered historic parks and gardens, registered historic battlefield, and its non-designated heritage assets [(referred to in Barnet as local heritage assets)] (including assets on Barnet’s Local Heritage List) are conserved and enhanced in a manner appropriate to their significance."

CDH08 part E is amended to read:

"E. Non-Designated [Local] Heritage Assets

The Council will conserve [local] non designated heritage assets (including assets on Barnet’s Local Heritage List) and their settings in a manner appropriate to their significance."

Para 6.32.1 is amended to read:

"Barnet has a Local Heritage List which formally identifies buildings of historic or architectural interest. The Council may also identify any non-designated heritage asset as part of the decision-making process on planning applications (see NPPG para: 039 Reference ID: 18a-040- 20190723)."

The Council believe that these changes, in addition to the reference in the first line of para 6.32.1 (as modified) to ‘and other assets’ adequately captures distinctions between non-designated heritage assets on Barnet’s Local Heritage List and other non-designated heritage assets.

CDH08(F) - The Council does not consider it necessary to expand beyond the requirements of NPPF para 200 in terms of archaeological desk-based assessments and, where necessary, field evaluations. The Council do not consider it necessary to explain the planned tiering of APAs in the Borough, as it would not have an impact on the soundness or applicability of the policy. The future review of APAs would be considered as part of the early review of the Local Plan (as set out in Paragraph 2 of the Appendix to Inspector’s letter dated 17 August 2023).

The Council does not consider it necessary to set out in the Local Plan where GLAAS and HADAS may be consulted. This can be addressed as part of the development management function.

Scheduled Monuments - The first line of CDH08 states that in accordance with national policy, the Council will ensure that Barnet’s designated heritage assets, including its scheduled monuments, and its non-designated heritage assets, are conserved and enhanced in a manner appropriate to their significance. The Council therefore believe the policy approach according to national policy is clear.

Explanatory text - 

In light of Historic England’s comments, the Council does not oppose a change to para 6.23.3 as follows :

“In determining applications for planning permission that affect the significance of heritage assets, including any contribution made by their or their settings"

Historic England have suggested the Council commit to a review of the Local List criteria within the Local Plan. This is outside the purpose of this exercise. The Council are aware of HE Local Heritage Listing guidance and gave it consideration at the time of formulating the Council’s current Local List Criteria. Historic England were also part of that process at the time.

The Council acknowledge that GLAAS is part of Historic England and therefore propose to delete the word ‘and’ from para 6.33.1, so it now reads:

“The Council will consult with [Historic England and] GLAAS on the implications of development proposals in APAs. GLAAS holds further information on archaeological sites in Barnet.”

Reference to the GLHER is not considered necessary.

MM64 - ECC01

The Council do not consider it necessary for soundness to specify the type or age of construction that require more considered retrofit in Para 10.6.3A.. The recommendation that a condition survey is taken as a useful first step is not necessary as it is not a policy requirement, and would form part of the approach set out in the relevant Historic England guidance which is referenced in Para 10.6.3A.

MM80 - Schedule of Site Proposal

As part of the early review of the Local Plan (as set out in Para 2 of the Appendix to Inspector’s letter dated 17 August 2023) there will be a review of the APAs. The Council confirm that the APAs are all correctly referenced in the designations for each site proposal (in the ‘Planning Designations’ box).

The Council does not consider it necessary to repeat the policy requirements of Policy CDH08 within each site allocation. Furthermore, the Main Modifications removed the selected policies previously identified as relevant in the Plan as submitted because when planning permission is sought for development proposals, compliance will be assessed in terms of any relevant policies of the Plan and its accordance with the development plan as whole.

The Council do not consider it necessary to replace ‘conservation areas’ with ‘heritage assets’ in Paragraph 16.1.6 as the preceding text says ‘such as’ thus only seeking to provide examples. It does not imply it is a ‘special category’.

MM 104 – Site 23- the Planning Designations box should be amended to state ‘Listed Buildings’.

The Site Description box should be amended to state:

"The site contains [a] two Grade II listed buildings…" and the Site Requirements and Development Guidelines should be amended to refer to plural listed buildings.

Considering Heritage England’s comments, MM 131 – Site 51 – Great North Road Local Centre - should have ‘Listed Building’ added to the Planning Designations box.

MM 83 - Site 1 –The Council does not consider it necessary to repeat the policy requirements for heritage assets.

MM 89 - Site 7 – The Council does not consider that a cross reference to CDH08 is merited.

MM 105 - Site 24 – Site requirements and development guidelines box amended to read: “Sensitive design is vital to conserve [and] or enhance the significance of the adjacent Grade II listed station building and adjacent Hampstead Garden Suburb Conservation Area including any contribution made by [and] their settings.” The Council do not consider it necessary for the modification to refer to townscape or Historic England’s Streets for All Guidance.

MM 108 - Site 27 –The Council does not consider it necessary to repeat the policy requirements for heritage assets.

MM 109 - Site 28 – The Council does not consider the existing wording is inconsistent with the NPPF.

MM 120 - Site 40 - The Council does not consider Historic England’s suggested wording alters or improves the soundness.

  1. EXAM 36 sets out the assumptions behind the calculation of the indicative capacity, and the use of the Density Matrix.
  2. The planning application will be assessed against Local Plan policies, design guidance and the principles of Secured by Design. Partners such as the Metropolitan Police and the London Fire and Emergency Planning Authority will contribute to this assessment.
  3. The Edgware Growth Area SPD highlights requirements for Edgware bus station. This includes maintaining a central location, enabling easy interchange, overcoming severance with Station Road, reducing conflict with pedestrian access, providing intuitive way finding as well as offering high quality passenger information and waiting facilities. The Council wants to ensure integration of the bus station with its surrounding context.
  4. The Council refers to its earlier response on use of the Density Matrix
  5. Edgware, along with Brent Cross, Brent Cross West (Staples Corner), Colindale and Cricklewood is a Growth Area. Growth Areas are distinctive locations with good public transport accessibility. They have a supply of brownfield and underused land and buildings that offer opportunities for inward investment.
  6. The evolution of the Local Plan has long acknowledged Edgware as an important suburban and to some extent urban hub that is a location for opportunities that may bring new investment and revitalisation. The indicative densities for new homes in the Local Plan reflect the planning and locational context of the 2 sites the Underground, the Bus Station as well as the Broadwalk shopping centre all located within 800 metres of a major town centre. The sustainable strategy for growth is to direct investment towards brownfield sites, especially those in town centres. Proposed densities in the Local Plan reflect the context of the 2 proposals sites which include the station as well as the Broadwalk shopping centre. These 2 sites have a mix of different uses, large building footprints and typically buildings of 4 to 6 storeys located within 800 metres of a major town centre which Edgware is designated as. This is consistent with the proposed densities in the Local Plan. The Council will assess the recently submitted planning application  against the policies, including one on heritage, in the newly adopted Local Plan as well as the detailed framework set out in the Edgware Growth Area SPD. The SPD which we produced jointly with Harrow Council highlights that Edgware can draw on its unique character and features while seeking new offerings to enhance the town centre’s appeal and support its businesses.
